Welcome to Hide Society Africa! The terms "we", "us" and "our" refer to Hide Society Africa. Hide Society operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Hide Society Africa is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein, including our Shipping Policy and Returns & Refund Policy (collectively, these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including accessing or browsing our online store or purchasing any of the products we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our store is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR PRODUCTS & NATURAL VARIATION We have made every effort to provide an accurate representation of our products in our online store. However, because our products are authentic, natural zebra hides, you acknowledge and agree to the following:

  • Uniqueness: No two hides are identical. Variations in stripe patterns, color tones, and dimensions are inherent to the product.

  • Natural Markings: Authentic hides may feature "marks of the wild," including healed scars, scratches, or minor skin variations. These are not considered defects but are hallmarks of a genuine, natural specimen.

  • Display Accuracy: Colors or product appearance may differ from how they appear on your screen due to the type of device you use and your device settings. We cannot guarantee that your device’s display of any color or texture will be 100% accurate.

  • Descriptions: All descriptions of products are subject to change at any time without notice at our sole discretion.

SECTION 3 - ORDERS, EXPORT & STATE RESTRICTIONS When you place an order, you are making an offer to purchase. Hide Society reserves the right to accept or decline your order for any reason at its discretion.

  • Acceptance: Your order is not accepted until Hide Society Africa confirms acceptance. We must receive and process your payment before your order is accepted.

  • Personal Use Only: You represent and warrant that your purchases are for your own personal or household use and not for commercial resale.

  • Federal Re-Export Prohibition: Our products are imported under strict U.S. Fish & Wildlife (USFWS) and CITES regulations. You are strictly prohibited from exporting, shipping, or carrying these products outside of the United States without obtaining your own federal CITES re-export permits. Hide Society Africa is not liable for any legal consequences arising from your unauthorized export of these goods.

  • California Sales: Pursuant to California Penal Code Section 653o, we do not sell or ship products to the state of California. Any orders destined for California will be canceled and refunded.

SECTION 4 - PRICES AND BILLING Prices, discounts and promotions are subject to change without notice. Unless otherwise expressly stated, posted prices do not include taxes or shipping. You agree to provide current, complete and accurate purchase, payment and account information for all purchases. You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are authorized to use such card, and (iii) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes.

SECTION 5 - SHIPPING AND DELIVERY All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers or events outside our control. Once we transfer products to the carrier (UPS), title and risk of loss passes to you.

  • Adult Signature: Due to the high value of our products, all shipments strictly require an Adult Signature upon delivery.

  • Failed Delivery: If an order is returned to our facility due to an incorrect address or failed delivery attempts (failure to provide a signature), the customer will be responsible for the actual "Return to Sender" costs charged by UPS, in addition to the costs of resending the item.

SECTION 6 - INTELLECTUAL PROPERTY Our Services, including but not limited to all trademarks, brands, text, displays, images, and photography, are owned by Hide Society Africa, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws. You must not reproduce, distribute, modify, or create derivative works of any material on the Services without our prior written consent.

SECTION 7 - OPTIONAL TOOLS We may provide you with access to third-party tools (such as WhatsApp for consultations) which we neither monitor nor have any control over. You acknowledge and agree that we provide access to such tools "as is" without any warranties. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

SECTION 8 - THIRD-PARTY LINKS The Services may contain hyperlinks to websites provided or operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials. We are not liable for any harm or damages related to the purchase or use of products, services, or content on any third-party websites.

SECTION 9 - RELATIONSHIP WITH SHOPIFY Hide Society Africa is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Hide Society Africa. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Hide Society Africa, including any injury, damage, or loss resulting from purchased products. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Hide Society Africa.

SECTION 10 - PRIVACY POLICY All personal information we collect through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you.

SECTION 11 - FEEDBACK If you submit reviews, photos, or suggestions ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, and display such Feedback in any medium for any purpose, including for commercial and marketing use. We are under no obligation to maintain Feedback in confidence or pay compensation for its use.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS Occasionally there may be information in the Services that contains typographical errors or omissions related to product descriptions, pricing, or availability. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.

SECTION 13 - PROHIBITED USES In addition to standard prohibitions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to violate any international, federal, or state wildlife regulations and local ordinances; (c) to infringe upon or violate our intellectual property rights; (d) to harass or intimidate our employees; or (e) to collect or track the personal information of others.

SECTION 14 - AGENTS No software or "Agent" may access or interact with Services unless it identifies itself truthfully and operates in strict accordance with technical requirements. We may limit or block any Agent that mimics human behavior or circumvents CAPTCHAs.

SECTION 15 - TERMINATION We may terminate this agreement or your access to the Services at any time without notice for a violation of these Terms. Provisions regarding Intellectual Property, Liability, and Governing Law shall survive termination.

SECTION 16 - DISCLAIMER OF WARRANTIES EXCEPT AS EXPRESSLY STATED BY HIDE SOCIETY AFRICA, THE SERVICES AND ALL PRODUCTS ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT ANY REPRESENTATION OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, DURABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.

SECTION 17 - LIMITATION OF LIABILITY TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL HIDE SOCIETY, OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

SECTION 18 - INDEMNIFICATION You agree to indemnify, defend and hold harmless Hide Society Africa and Shopify from any claims, including reasonable attorneys' fees, arising out of (1) your breach of these Terms, (2) your violation of any law (including wildlife export laws), or (3) your access to and use of the Services.

SECTION 19 - SEVERABILITY In the event that any provision of these Terms is determined to be unlawful or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms.

SECTION 20 - GOVERNING LAW These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the State of Florida. You and Hide Society Africa consent to the exclusive venue and personal jurisdiction of the federal and state courts located in Escambia County, Florida.

SECTION 21 - CHANGES TO TERMS OF SERVICE We reserve the right, in our sole discretion, to update or change any part of these Terms of Service by posting updates to our website. It is your responsibility to check our website periodically for changes.
